48-Hour Delivery Guarantee

We guarantee that your website will be live and functional within 48 hours of receiving your completed order form and payment. If we fail to meet this deadline, you are entitled to a full refund.

3. Service Agreement and Pricing

Setup Fee

Our website development service requires a one-time setup fee of $500, which includes:

  • Professional website design and development
  • Mobile-responsive layout
  • SEO optimization
  • Contact forms and basic integrations
  • SSL certificate installation
  • Initial content upload

Monthly Maintenance

Ongoing website maintenance is provided for $50 per month, which includes:

  • Premium hosting and CDN services
  • Security updates and monitoring
  • Content updates (up to 2 hours per month)
  • Performance optimization
  • Regular backups and recovery
  • 24/7 technical support
  • 99.9% uptime guarantee

Additional Services

Additional content updates beyond the included 2 hours per month are available at $75 per hour. Custom development work is quoted separately based on project requirements.

4. Payment Terms

Setup Payment

The $500 setup fee is due in full before work begins on your website. Payment can be made via credit card, PayPal, or bank transfer.

Monthly Billing

Monthly maintenance fees are billed automatically on the same date each month. Payment is due within 5 days of the billing date.

Late Payments

Late payments may result in:

  • Suspension of services after 10 days
  • Late fees of $25 per month
  • Website takedown after 30 days of non-payment

Refund Policy

Setup fees are refundable only if we fail to deliver your website within 48 hours. Monthly maintenance fees are non-refundable but you may cancel at any time with 30 days notice.

5. Client Responsibilities

To ensure successful project completion, you agree to:

  • Provide accurate and complete information in the order form
  • Supply all necessary content, images, and materials within 24 hours of order placement
  • Respond to our communications within 12 hours during the development process
  • Review and approve the website design within the specified timeframe
  • Ensure all provided content is original or properly licensed
  • Maintain current contact information for billing and support

6. Intellectual Property Rights

Your Content

You retain ownership of all content, images, and materials you provide. By submitting content to us, you grant us a license to use, modify, and display such content for the purpose of creating and maintaining your website.

Website Code and Design

Upon full payment of the setup fee, you own the website code and design created specifically for your project. However, we retain rights to:

  • Template frameworks and base code
  • Proprietary tools and methodologies
  • General design concepts and techniques

Third-Party Components

Your website may include third-party components (plugins, libraries, fonts) that are subject to their respective licenses.

7. Content Guidelines and Restrictions

We reserve the right to refuse service or terminate accounts that contain:

  • Illegal, harmful, or offensive content
  • Copyrighted material without proper authorization
  • Adult content or explicit material
  • Hate speech, discrimination, or harassment
  • Spam, malware, or malicious code
  • Content that violates third-party rights
  • Misleading or fraudulent information

8. Service Level Agreements

Uptime Guarantee

We guarantee 99.9% uptime for hosted websites. If uptime falls below this threshold in any given month, you may be eligible for service credits.

Support Response Times

  • Critical Issues: 2 hours
  • General Support: 24 hours
  • Content Updates: 48 hours

Maintenance Windows

Scheduled maintenance may occur during off-peak hours (typically 2-4 AM EST) with advance notice when possible.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for loss of profits, data, or business opportunities
  • You acknowledge that internet services may experience interruptions beyond our control

Important Notice

While we strive to provide reliable services, we cannot guarantee uninterrupted access or error-free operation. You are responsible for maintaining backups of your important data.

10. Termination

Termination by You

You may terminate our services at any time with 30 days written notice. Upon termination:

  • You will receive a final backup of your website
  • Your website will be removed from our servers
  • No refunds will be provided for unused portions of monthly fees
  • You retain ownership of your website files and content

Termination by Us

We may terminate services immediately if you:

  • Violate these Terms of Service
  • Fail to pay fees after 30 days
  • Use our services for illegal activities
  • Abuse our support staff or systems

11. Data Protection and Privacy

We are committed to protecting your privacy and personal information. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy commitments:

  • We do not sell or share your personal information with third parties
  • All data transmission is encrypted using industry-standard protocols
  • We maintain regular backups of your website data

12. Force Majeure
